As relações interinstitucionais no sistema socioeducativo: uma análise em Minas Gerais

Resumo
A “Doutrina da Proteção Integral”, que passa a reconhecer a criança e o adolescente como sujeitos de direitos, tem como principais instrumentos de sua consolidação no país a Constituição da República Federativa do Brasil de 1988 (CRFB/88) e o Estatuto da Criança e do Adolescente (ECA). De acordo com a CRFB/88, os menores de dezoito anos são inimputáveis e sujeitos às normas da legislação especial, a saber: as medidas socioeducativas previstas pelo ECA e regulamentadas pelo Sistema Nacional de Atendimento Socioeducativo (Sinase). A implementação da política do sistema socioeducativo pode ser considerada complexa, não só pelos seus objetivos, mas, principalmente, pela diversidade de instituições envolvidas em todo o seu processo decisório e de execução. Nesse campo encontra-se o presente estudo que objetiva a análise da execução das medidas socioeducativas no Estado de Minas Gerais, com foco nas relações entre as instituições envolvidas, buscando identificar os prováveis entraves institucionais e as possíveis respostas para a minimização de seus efeitos negativos na implementação da política pública. Nesse aspecto, estuda-se os dilemas de articulação entre os atores. Para isso, a pesquisa caracteriza-se como qualitativa e utiliza de revisão bibliográfica, análise documental e pesquisa de campo - dividida entre a aplicação de entrevistas semiestruturadas e observação direta. As conclusões foram no sentido de que, mesmo existindo instrumentos específicos no Estado de Minas Gerais que favoreçam a articulação, existem entraves que necessitam ser solucionados para o melhor funcionamento do sistema, como a personificação das relações interinstitucionais, relações do Poder Executivo com os órgãos do sistema de justiça potencialmente fragilizadas, um aspecto frágil de conhecimento sobre as funções de uma instituição pelas outras e com uma perspectiva de grande parte da sociedade atual que não adere aos pressupostos do sistema.
Abstract
The "Doctrine of Integral Protection", which recognizes children and adolescents as subjects of rights, has as main instruments of its consolidation in Brazil the Constitution of the Federative Republic of Brazil of 1988 (CRFB / 88) and the Statute of the Child and Adolescents (ECA). According to CRFB / 88, minors under the age of eighteen are unimpeachable and subject to the norms of special legislation, namely: the socio-educational measures provided for by the ECA and regulated by the National System of Socio-Educational Assistance (Sinase). The implementation of the socio-educational system policy can be considered complex not only by its objectives, but also by the diversity of institutions involved in all its decision-making and implementation processes. In this field is the present study that aims to analyze the execution of socio-educational measures in the State of Minas Gerais, focusing on the relationships among the institutions involved, seeking to identify probable institutional obstacles and possible responses to minimize their negative effects on the implementation of public policy. In this aspect, the dilemmas of articulation between the actors are studied. For this, the research is characterized as qualitative and uses bibliographic review, documentary analysis and field research - divided between the application of semi-structured interviews and direct observation. The conclusions were that, although there are specific instruments in the State of Minas Gerais that favor articulation, there are obstacles that need to be solved for the better functioning of the system, such as the personification of interinstitutional relations, relations of the Executive Branch with the organs of the State. a fragile aspect of knowledge about the functions of one institution by the others and with a perspective of a large part of the current society that does not adhere to the presuppositions of the system.
