Its reflexes can be felt on various spheres, billions of public money are wasted and it leads to serious risk to democracy. In Brazil, awareness of its existence has increased. The term corruption indicates the distortion of rules for the benefit of non-public interests and this is precisely what is not expected of a public official. Accountability is the ability to be accountable and take responsibility for the use of funds by the public officer. Comprehensiveness of the institute is wide, highlighting O'DONNELL’s analysis, in its horizontal perspective, reafirming the existence of state agencies which would have the right and the legal power, and would be actually willing and able to perform routine control actions up to imposing sanctions against other agents or state agencies. Here we sought to verify whether the Brazil’s Attorney Office (Advocacia-Geral da União – AGU) could be set as a horizontal accountability agency. AGU would be one of the control agencies within the structure of the Brazilian public administration after several reforms that took place in the 1990s. The brazilian public administration lacks agencies specialized in fighting corruption and seeking accountability in a public structured way, not subject to political influence, having interinstitutional coordination and technical freedom of action. AGU’s role as an essential to justice and the Brazilian State institution in accordance to Brazil’s Constitution of 1988 would be to represent more than the Government, but the State also, faced with the duty, as its assignment, of checking legality / lawfulness of State action. In orther to fully perform such role, the AGU should present two major basic functions: to advise, through an also consultative role, the Executive Branch and to represent judicially and extrajudicially all Powers of the Brazilian Republic, including the parquet. Thus, AGU would exercise a function of institutional control, whether as the advisory or as the legal representation, control of legality (monitoring, promoting and protecting) of the rights and duties foressen in the Brazilian Constitution, including the inherent obligations of public management and implementation of public policies. For the AGU to be set up as a designated horizontal accountability agency such as outlined by O'DONNELL, the assigning features, technical ability and willingness, as well as certain distance from the Executive Branch had to be checked. The AGU, as analyzed, has a constitutional model and an institutional role with features that allow it to be framed as a horizontal accountability agency, but not immune to failure, particularly concerning the required distance from the Executive Branch, or border defense.Item Análise da discricionariedade nas decisões punitivas do Corpo de Bombeiros Militar de Minas Gerais: limites e controle(2018-11-06) Silva, Rosieli Ribeiro da; Jardim, Sérgio Murilo; Cruz, Matuzail Martins da; Soares, Helena Teixeira MagalhãesNesta pesquisa buscou-se identificar e analisar os principais aspectos discricionários das decisões punitivas disciplinares do Corpo de Bombeiros Militar de Minas Gerais. Isso, por meio da compreensão dos limites à discricionariedade e dos mecanismos de controle desses atos quando se desviam da Lei. Assim, foi procedida uma análise documental, sobretudo em torno da legislação disciplinar militar estadual, documentos públicos relacionados e jurisprudência relativa. A pesquisa identificou os aspectos discricionários e os analisou com amparo no embasamento teórico de consagrados juristas. Entre as conclusões, destacam-se como limitadores da discricionariedade os princípios e a própria lei que institui a norma. Eles sempre abalizarão a decisão conforme o ordenamento jurídico. Como mecanismos de controle estão os recursos administrativos e o controle judicial. Aponta-se, porém, a necessidade da definição da legislação sobre a reformatio in pejus e o estabelecimento de contornos mais precisos sobre a aplicação do art. 10, Lei 14.310. Essas medidas diminuirão decisões destoantes dentro da mesma administração em casos semelhantes. Cuidado esse que concorre para a sensação de justiça do administrado, segurança jurídica para a sociedade e correção de atitudes em uma atuação administrativa conforme o espírito de Lei 14.310/2002.Item Lei anticorrupção e dinamismo institucional: um olhar a partir da Controladoria-Geral do Estado de Minas Gerais(Fundação João Pinheiro, 2018-03-19) Azevedo, Anna Carolina de Oliveira; Carneiro, Ricardo; http://lattes.cnpq.br/6739881018308220; Costa, Bruno Lazzarotti Diniz; Rocha, Heloísa Helena NascimentoOn August 1, 2013, the Brazil edited the Federal Law No. 12846/2013, Anti-corruption Law, which establishes the administrative and civil liability of legal persons for harmful acts committed against the National Public Administration or foreigner. Associated with the fulfillment of international commitments assumed by the country, the new legislation included in the repertoire of institutional confrontation of corruption by the brazilian State and focuses on the environment and the institutional arrangement of the control Public Administration, in particular the organs of internal control that, in the last two decades, have incorporated new assignments and procedures linked to the prevention and fight against corruption. In this context, the present study aims to analyse the general process of institutionalization of administrative accountability activity of legal entities by the CGE-MG, central organ of internal control of the state of Minas Gerais, from the Anti-corruption Law. Search, understand the skills that the cited legislation introduces in the performance of this organ, the way he seeks to approve the new competence and it changes your perspective incidents institutional design in a broad sense. The research, exploratory, qualitative approach adopts and develops in the form of case studies, covering literature review of theoretical institutionalist and other contextual themes, analysis of documents relating to the institutional trajectory GCE-MG and of legal texts and related legal doctrines, as well as collection and analysis of primary data, obtained by means of semi-structured interviews with officers of the CGE-MG whose work relates directly to the implementation of the Anti-corruption Law. In terms of results, the institutionalization of liability of legal persons is in the process of construction by the CGE-MG, being perceived institutional changes of endogenous nature, related to dimensions strategic and operational performance of the organ, as well as institutional changes of a systemic nature, associated with the interaction with other public agencies and entities representing the field of internal control, with the media and with sector agents private.
