dc.description.abstractEsta monografia tem como escopo analisar o Regime Próprio de Previdência Social de Minas Gerais à luz do Princípio da Eficiência Pública conforme definição de Onofre Alves Batista Junior. Para isso, buscou-se compreender a problemática da Previdência Social no Brasil enquanto componente do Sistema de Seguridade Social, cuja finalidade primordial é assegurar direitos relacionados à Saúde, Previdência Social e Assistência Social, frente à discussão acerca de sua suposta ineficiência e insustentabilidade. A metodologia utilizada foi a pesquisa exploratória e bibliográfica, por meio da qual foi possível a acepção dos conceitos básicos para o desenvolvimento do trabalho. Iniciou-se com o estudo do Princípio da Eficiência Pública de acordo com a concepção de Batista Junior, oportunidade em que se entendeu as suas diferenças para a eficiência privada e em que se demarcou seu principal objetivo que consiste na satisfação do bem comum. Em seguida, apresentouse o Sistema de Seguridade Social do Brasil, a partir do entendimento da importância das políticas de proteção social, e os regimes previdenciários e financeiros admitidos no país. Nesse momento, mostrou-se fundamental o estudo mais aprofundado acerca do Regime Próprio de Previdência Social, objeto de estudo do presente trabalho, sendo estabelecidas, ainda, algumas considerações sobre os efeitos da Emenda Constitucional nº 103/2019. Por fim, analisou-se o Regime Próprio de Previdência Social de Minas Gerais à luz do Princípio da Eficiência, o que foi realizado a partir da apresentação de seus aspectos jurídicos-normativos e da apresentação das propostas de sua adequação à Reforma da Previdências. Considerando a possibilidade de funcionar como política redistributiva e, ainda, de garantir a renda da população contribuinte que não mais possui capacidade laborativa, percebe-se que a Previdência Social e o Regime Próprio de Previdência Social, nos moldes atuais, não cumpre seu papel constitucional, podendo ser considerando ineficiente, de acordo com a teoria da eficiência pública adotada por Batista Junior, que se preocupa, prioritariamente, com a satisfação do bem público e da justiça social.pt_BR
dc.description.abstractThis work aims to analyze the (in) efficiency of the Minas Gerais Social Security System in the light of the Public Efficiency Principle as defined by Onofre Alves Batista Junior. To this end, we sought to understand the problem of Social Security in Brazil as a component of the Social Security System, whose primary purpose is to ensure rights related to Health, Social Security and Social Assistance, in the face of the discussion about its supposed inefficiency and unsustainability. The methodology used was exploratory and bibliographic research, through which it was possible to understand the basic concepts for the development of the work. In order to acomplish the objectives listed in the Introduction, we began with the study of the Principle of Public Efficiency according to the concept of Batista Junior, in which its differences for private efficiency were understood and in which it was demarcated its main objective is the satisfaction of the common good. Then, the Brazilian Social Security System was introduced, based on the understanding of the importance of social protection policies, and the social security and financial regimes admitted in the country. At this point, the most in-depth study on the Social Security System, which is the object of study in this study, proved to be fundamental, and some considerations were also made on the effects of Constitutional Amendment No. 103/2019. Finally, the Minas Gerais Social Security Regime was analyzed in the light of the Efficiency Principle, which was accomplished from the presentation of its legal-normative aspects and the presentation of the proposals for its adequacy to the Social Security Reform. Considering the possibility of functioning as a redistributive policy and, still, of guaranteeing the income of the taxpayer population that no longer has working capacity, it is clear that Social Security and the Social Security System, in the current mold, does not fulfill its constitutional role , which can be considered inefficient, according to the theory of public efficiency adopted by Batista Junior, who is concerned, primarily, with the satisfaction of the public good and social justice.pt_BR
