Resumo
Este artigo estuda os novos marcos que reenquadram o planejamento e as políticas urbanas no âmbito local no Brasil contemporâneo, a partir da Constituição Federal (CF) de 1988 e avanços subsequentes. A discussão introdutória referencia a problemática urbana brasileira e os padrões antecedentes do planejamento urbano no País, especificamente a partir dos planos diretores e congêneres. A seção seguinte identifica e analisa os avanços cunhados na CF/1988, no Estatuto da Cidade e, mais recentemente, nas resoluções do ConCidades, que reorientam as políticas, o planejamento e a gestão urbanas, apontando-se, também, alguns limites e contradições observados em sua arquitetura institucional. Posteriormente, apresenta-se, em caráter ilustrativo, um panorama dos desdobramentos dos referidos avanços no âmbito local, a partir dos novos planos diretores municipais. As considerações finais sintetizam aspectos marcantes da argumentação construída, salientando o desafio imbricado na efetiva incorporação das inovações institucionais pelas municipalidades.
Abstract
The paper explores the new legal references that constitutes a framework for local urban planning and policies in contemporary Brazil, starting from Federal Constitution of 1988 (CF/1988) and following the subsequent progresses. As an introductory approach, it references the Brazilian urban issues and the previous patterns of the urban planning in the country, especially concerning the cities master plans and similar tools. The second section identifies and analyzes the innovations in CF/1988, in the Statute of the City and, more recently, in the normative resolutions of the National Council of Cities, that reorient urban policies, planning and management. Also identifies some limits and contradictions observed in their institutional design. The following section offers a view of the institutional arrangements at the local level that may be associated to the referred innovations, such as the new municipal master plans. The final considerations synthesize outstanding aspects of the argument, pointing out the challenge involved in the effective incorporation of the institutional innovations for the municipalities.
