Este trabalho aborda o controle jurisdicional da atividade administrativa. O objetivo geral é analisar os limites da função de Controle exercida pelo Poder Judiciário sobre o Poder Executivo, a partir do caso da OUC – Nova BH. É estabelecido um referencial teórico para compreender a Recomendação 008/2013 emitida pelo Ministério Público de Minas Gerais para a Prefeitura de Belo Horizonte (PBH). Para tanto, a pesquisa, de natureza qualitativa, constrói um arcabouço teórico onde delimita o contexto no qual se inscreve, qual seja, o Estado Democrático de Direito, e segue para a delimitação conceitual das duas variáveis em destaque: o controle jurisdicional da Administração Pública e o marco legal das Operações Urbanas Consorciadas. A partir desse embasamento, é realizado o estudo de caso da Recomendação do Ministério Público, que está anexada ao final da pesquisa. Destaca-se a eficácia do poder de controle atribuído ao Ministério Público ao apontar vícios da atividade administrativa, principalmente no que diz respeito à participação popular nas instâncias adequadas.
Abstract
This work deals with the judicial review of administrative activity. The general objective is to analyze the limits of the control function exercised by the judiciary on the executive branch, from the case of OUC - New BH. It established a theoretical framework for understanding the Recommendation 008/2013 issued by the Public Prosecutor of Minas Gerais to the city of Belo Horizonte (PBH). Therefore, the research of a qualitative nature, build a theoretical framework which defines the context in which it is included, that is, the democratic rule of law, and follows the conceptual delimitation of the two featured variables: the jurisdictional control of the Public Administration and the legal framework of the Urban Operations Consortium. From that foundation, it is carried out the case study the recommendation of the Public Ministry, which is attached to the end of the survey. There is the controlling power of the efficacy attributed to the prosecutor to point vices of administrative activity, especially with regard to popular participation in the forums.
