Política de atendimento a adolescentes em conflito com a lei em medida de privação de liberdade: o desafio de implementação do ECA em um contexto institucional composto por duas lógicas distintas, a coerção e a socialização

Resumo
O presente trabalho buscou analisar as formas de implementação dos princípios do Estatuto da Criança e do Adolescente (ECA) e do Sistema Nacional de Atendimento Socioeducativo (SINASE) em diferentes centros socioeducativos. O estudo também buscou compreender as maneiras como estas instituições lidam com a presença de duas lógicas distintas e coexistentes na política de atendimento ao adolescente em privação de liberdade: a coerção e a socialização. A análise foi feita a partir de pesquisa bibliográfica, análise documental e entrevistas, configurando estudos de caso em duas unidades de internação de Minas Gerais: o Centro Socioeducativo 1, localizado em Belo Horizonte, e o Centro Socioeducativo 2, localizado em Sete Lagoas. Os estudos de caso nos dois centros demonstraram que a política é implementada de forma diferenciada em instituições diferentes, sendo alterada principalmente pelos seguintes fatores: a estrutura física, material e organizacional das unidades, o perfil dos internos e as visões dos implementadores sobre as normativas e sobre os próprios adolescentes. A articulação entre as lógicas da coerção e da socialização também ocorre de forma diferenciada nos dois centros, sendo influenciada pela resistência dos atores às mudanças da legislação, pela dualidade inerente à política - que articula objetivos ligados à manutenção da segurança a propostas de reinserção social com respeito à singularidade do adolescente- e pelas visões e concepções dos implementadores sobre as normativas e sobre as ações punitivas e pedagógicas.
Abstract
The present work aimed to analyze the strategies of implementation of the principles of the Statute of the Children and Adolescents (ECA) and of the National System of Socioeducational Service (SINASE) in different socioeducational centers. The study also sought to understand the ways that these institutions deal with the presence of two distinct and simultaneous logics in the policy focused on the adolescents in deprivation of liberty: the coercion and the socialization. The analysis was based on bibliographic research, documentary analysis and interviews, setting up case studies in two socioeducational centers in Minas Gerais: the "Centro Socioeducativo Santa Clara", located in Belo Horizonte, and the "Centro Socioeducativo de Sete Lagoas", located in Sete Lagoas municipality. The case studies of the two socioeducational centers showed that the policy is implemented in distinct ways in the two institutions and that it has been being changed mainly by the following factors: the physical, material and organizational structure of the units; the profile of the adolescents; and the visions of the front-line bureaucrats about the norms and about the own adolescents. The articulation between the logics of the coercion and of the socializing also occurs in differentiated ways in the two centers, influenced by institutional path dependence of the units, by policy framework's inherent duality - that articulates objectives related to security maintenance with the proposals of social reintegration taking into account the adolescents singularity - and by the visions and conceptions of the front-line bureaucrats about the punitive and pedagogical actions.
