    Análise da aplicação das compras de pequeno valor sob a ótica da Nova Lei de Licitações e Contratos: análise de caso no Departamento de Estradas de Rodagem do Estado de Minas Gerais (DER-MG)

    A Lei Federal no 14.133/2021 introduziu mudanças significativas no sistema de licitações e contratos da Administração Pública. Este trabalho, por meio de uma análise de caso, analisa as implicações dessa nova legislação nas contratações dispensadas por valor, expressas no art. 75, incs. I e II da Lei Federal no 14.133/2021, no Departamento de Estradas de Rodagem do Estado de Minas Gerais (DER-MG). Utilizando dados coletados de processos de compras pelo órgão no período de 2009 a 2024, a pesquisa investiga a eficiência das contratações do DER-MG após a implementação da Nova Lei de Licitações e Contratos, analisando como o perfil de compras de pequeno valor se alterou, investigando como esta modalidade é influenciada pelas inovações e regulamentações introduzidas pela nova legislação, considerando o aumento do limite para dispensa de licitação e a inserção de um fator anual de reajuste. Os resultados demonstram que a nova lei pode estar relacionada ao aumento do uso da modalidade de dispensa por valor no Departamento, contudo, há necessidade de que novos estudos sejam realizados para aprofundar o tema.

    Aplicação do modelo de gestão em rede organizacional às políticas públicas de segurança : o caso da política de integração do sistema de Defesa Social de Minas Gerais

    The Government of the State of Minas Gerais implemented from 2003 a set of actions, restructuring institutions and governance of the public safety policy, which sets out the institutional arrangement called "Social Defense System" and public policy called "Integration Policy of Social Defense System". Innovation in governance was assigned to horizontal and collegiate model, driven policy that works within the establishment, for all interventions, of thematic integrated instances. This dissertation proposes an analysis of the conformation of the Integration Policy, from references of the fields of public management and neo-institutionalism theory, concerning the dynamics of the network and the construction of legitimacy. The intention was to analyze relevant issues to the present model of governance of public security, which refer not only to the trajectory and characteristics of the formation of organizational network, as well as its intersection with aspects of the institutional context. Qualitative methodology was applied, combining descriptive and exploratory elements from literature and documents from secondary sources, composed of the documents produced by the Social Defense System in the context of projects and activities of the Integration Policy (legislation, documents, technical reports, etc.), as well as a set of semi-structured interviews and workshops conducted by João Pinheiro Foundation for the project of the 2013-2015 State Plan for Social Defense. The conclusion is that, in a context strongly marked by path dependency, disarticulation, imbalances of power and legitimacy, the application of network governance demonstrated a potentially qualified path to institutionalize dialogue and seek more objective parameters to the minimum necessary coordination implementation of built and run multi-managed policies, such as the public safety policies in Minas Gerais.

    Papel das ouvidorias : estudo de caso da Ouvidoria Geral do Estado de Minas Gerais

    This paper presents the role of the Public Ombudsman and specifically presents a case study of the Ombudsman of the State of Minas Gerais. Initially, it presents a comparison of the major democratic conceptions, emphasizing the view that each of them develops the concept of participation in the functioning of democracy. This paper shows the origin and historical repercussions of the institute of the "Ombudsman", in Sweden as well as the trajectory of the institute in Brazil. Then, it presents the legal treatment given to popular participation and to the Ombudsman at the federal and at the State of Minas Gerais. It shows the role of the Ombudsman in Minas Gerais, so there are exposed the main features of this institution, and its key initiatives. It also presents general considerations about the Ombudsman in five other states in Brazil. The study shows that the Public Ombudsman arise as a tool in support of democratic deepening. However, it is noted that the institute needs more attention to its improvement and to achieve greater legitimacy in its actions.

    In a scenario of growing global, regional and local crises, such as the Covid-19 pandemic, society is facing significant impacts. Governments have reacted with emergency measures to mitigate the negative effects. However, government policies, programs and actions, in addition to facing planning and execution challenges, also suffer from these external factors, which impact on the allocation of resources and the effectiveness of objectives. The Public Administration must look after the common good, ensuring that public policies are effective and benefit citizens, acting preventively to avoid discontinuity and failure in their results. With the advent of New Public Management, the administration has been modernized, absorbing corporate management practices from the private sector to improve its governance. Risk management, an important pillar in this process, applied in the development and implementation of public policies, can minimize their interruptions or discontinuities. This research focuses on the application of risk management in dealing with crises and mitigating the effects of public policies within the Executive Branch of the state of Minas Gerais, with the aim of understanding the challenges to their development in the state. While risk management aims to assess and act on potential threats, crisis management deals with manifest risks or damaging events. The study employs an exploratory qualitative methodology, linking risk management and crisis management in the formulation of public policies, focusing on the experience during the Covid-19 pandemic in Minas Gerais. The work includes a literature review, documentary research and individual interviews. The empirical analysis focused on the selection of strategic projects carried out by the state's executive branch. It is crucial that organizations develop competencies to manage risks and crises at all levels, and this should be thought of both ex ante and ex post in public policy. Although Minas Gerais is making progress in these matters, the challenges for institutionalization are broad, ranging from awareness of the relevance to effective integration into strategic actions and decisions. It is necessary to strengthen current practices and foster a culture of risk management to deal with crises, ensuring better results and the well-being of the population.

    Governança em tempos da Covid-19: o caso do sistema prisional mineiro

    With the pandemic caused by the new coronavirus, the world was forced to adapt its way of living and coexisting. The executive branch of the State of Minas Gerais declared a state of public calamity between March 2020 and December 2021, a period in which several measures were adopted based on the implementation of a governance structure with the main aim of curbing the spread of the virus, mitigating the effects of the disease and ensure the continuity of public services. Within the scope of the Minas Gerais prison system, the second most populous in the country, characterized by a large number of units and overcrowding, an emergency public governance structure was established, responsible for the decisions of that public policy. The dissertation analyzes the governance arrangement during the Covid-19 pandemic, verifying the functioning of the prison system and the maintenance of custody processes and assistance to the prisoner. Based on the mobilization of a theoretical framework related to Covid-19, the prison system and public governance, qualitative and descriptive research was carried out through a case study in Minas Gerais during the pandemic period. As instruments for data collection, literature review, documentary surveys, semi-structured interviews and technical visits were used. The documentary analysis involved 204 Deliberations of the Covid-19 Extraordinary Committee, 186 state normative acts, 14 federal normative acts and 31 state and federal legislation relevant to the subject. There were also 16 interviews with key actors identified in the research process, such as state public servants of Minas Gerais in public safety, health, ombudsman, Public Ministry, Public Defender, Judiciary and representatives of lawyers, trade unions and friends and family of prisoners. A technical visit to the prison unit was also carried out to verify the processes of custody and assistance to the prisoner in the pandemic period, using a record in a field notebook. Research findings indicate the introduction of measures to protect the health of civil servants and convicts, changes in the organization of the work process, implementation of the recommendations of the National Council of Justice, and influence of external actors in state governance, such as the federal government, Judiciary and Public Ministry. The research also revealed that the prisoner's access to assistance guarantees was limited, but the idea of protection aimed at by governance can be demonstrated as the data obtained showed a non-expressive number of prisoners who died due to Covid-19. The dissertation contributes to prison management with the dissemination of information about the modus operandi of action in the prison system of Minas Gerais during the pandemic, enabling its application, in the future, by other public entities in similar situations. New studies are suggested to evaluate the routine of prison units after the pandemic period; verifying whether the experience of Covid-19 and the governance arrangement itself will contribute to the improvement of prison management; of comparative analysis between other states and countries to understand how they were organized and the results obtained for their prison systems.

    Rumo a uma gestão inclusiva de recursos humanos na administração pública : como identificar e fechar as lacunas de gênero

    Um setor público diversificado beneficia tanto os governos quanto a sociedade em geral. Para aproveitar ao máximo esses benefícios, é essencial implementar uma Gestão Inclusiva de Recursos Humanos (GIRH). Este artigo enfatiza a urgência de estabelecer uma GIRH no setor público e apresenta um índice inovador para medi-la, aplicado no contexto do Brasil. Os princípios de mérito e promoção da diversidade são complementares, e uma GIRH estratégica é necessária para gerenciar a diversidade, promover igualdade de oportunidades e melhorar o desempenho das organizações públicas. Apesar dos esforços do governo brasileiro, a presença de mulheres no setor público permanece limitada, especialmente em posições de liderança. Para lidar com essa desigualdade, são propostas recomendações que incluem a geração e o uso de informações, a implementação de medidas para combater preconceitos, a facilitação da conciliação entre trabalho e família, a transparência nas diferenças salariais e programas para incentivar a participação das mulheres em cargos de liderança. Essas ações buscam fechar as lacunas de gênero e melhorar a gestão pública no Brasil.

    As instituições e o uso das informações na avaliação das políticas públicas executadas em parceria com entidades sem fins lucrativos no estado de Minas Gerais

    This paper is a case study which aims to analyze how the information used in the evaluation of public policies implemented in partnership with nonprofits organizations in Minas Gerais are perceived by the stakeholders and whether this perception is lined with the institutional roles set in that particular network.Through the identification of key information products presented in institutional documents and literature related to the subject, it is proposed to characterize some of the main aspects of this dynamic and understand how the relationships between the institutions involved may influence the perception and use of information. From the results obtained in the study it was concluded that the importance given by the representatives of the institutions involved about the information products selected reflects and illustrates the dynamics of the network's interfaces, sometimes being aligned to the defined institutional roles for each of the groups surveyed, and, at other times, highlighting dysfunctions.

    The New Public Management provide favorable conditions for creation of a Shared Services Center in Public Administration of Minas Gerais. This is a means of management, characteristic of private enterprise, which concentrates the implementation of support processes, common to different units of the organization, a new administrative unit, to offer them to other standardized, efficient and effective areas. The concentration of these common processes before decentralized by various sectors of the organization, a new administrative unit, brings changes to the reality of the organization, ranging from the impact on power relations to change administrative procedures. In this sense, this paper makes a case study on the organizational change process resulting from implementation of the Shared Services Centre in the Government of Minas Gerais, from the four main aspects analysis: context of change, its contents, the process of implementation and the people it affected. To perform this study, we made bibliographic and documentary research, in addition to observing non-participants, the application of open questionnaires and semi-structured interviews. After the analysis, several aspects show that the CSC deployment project in Minas Gerais state government was not treated as an organizational change process and therefore the needs and listed characteristics in the literature for driving change processes were disregarded in its implementation, which may have been unfavorable to the project. Moreover, it is clear that the implementation of CSC was by a mechanistic perspective, which focused on a top-down model and control to achieve efficiency, leaving aside the need for awareness of those involved and adapting the organization to consolidate change.

    O uso da tecnologia Blockchain como ferramenta de combate à corrupção nas licitações públicas: perspectivas e desafios para a administração pública brasileira

    Este trabalho investiga o uso da tecnologia blockchain como ferramenta para combater a corrupção em licitações públicas no Brasil, promovendo maior transparência e eficiência na administração pública. Através de suas características de imutabilidade e descentralização, o blockchain permite que cada etapa do processo licitatório seja auditável e acessível, facilitando o monitoramento contínuo e reduzindo a manipulação e fraudes. A pesquisa examina desafios à implementação, como barreiras regulatórias e culturais, e analisa experiências internacionais para ilustrar os benefícios da tecnologia em processos governamentais. Com base nessa análise, são propostas diretrizes para uma adoção gradual da tecnologia no Brasil, incluindo projetos-piloto e capacitação técnica. Conclui-se que o blockchain tem potencial transformador para o sistema de licitações brasileiro, consolidando-se como uma ferramenta fundamental para uma governança mais ética e transparente.
