Il a pour objet l'étude des Institutions chargées de l'Accueil Institutionnel des enfants et des adolescents et analyse les progrès obtenus ainsi que les défis rencontrés par la Municipalité. Le développement de cette recherche se divise en trois étapes. La première étape a essayé de réaliser une recherche bibliographique et de produire des documents à propos de la politique publique ayant pour but l'accueil institutionnel. La seconde étape est une analyse de données découlant d'une enquête empirique, réalisée par la Fondation Joao Pinheiro. Finalement, la troisième étape relate la réalisation d'entrevues semi- structurées de certains membres importants du Secrétariat Municipal adjoint à l'Assistance Sociale et au Conseil Municipal des Droits de l'enfant et de l'adolescent, tous deux de la Municipalité de Belo Horizonte . Les résultats démontrent que la politique publique de la Municipalité trouve son origine dans un processus lent, non uniforme, où prédominèrent des actions ponctuelles, au contraire d'une structure ordonnée et planifiée, mais qui ont subi l'influence des directives nationales dans la mesure où cette politique a essayé de leur correspondre ; en outre, il fut possible d'observer que la structure responsable de la réalisation des mesures d'accueil institutionnel a également été directement influencéé par ces directives, en particulier par le Statut de l'Enfant et de l'Adolescent.Item Análise de duas parcerias público-privadas em Belo Horizonte a partir da ótica da gestão pública: educação e iluminação pública(Fundação João Pinheiro, 2019-03-27) Araujo Filho, Antonio Pereira de; Batitucci, Eduardo Cerqueira; Batitucci, Eduardo Cerqueira; Baêta , Adelaide Maria Coelho; Cruz, Marcus Vinícius Gonçalves daPublic administration in Brazil has gone through several crises, which became more explicit after the democratic return post-1988’s Constitution. However, its democratic and social bias did not address either the fiscal question or the coordination of the various federated entities. Disorganized actions appear in an effort to reduce the State, such as the beginning of the privatization process in the early 1990s. In 1995, a process of State reform begins, with a closer view of the market, appropriated from the British model of New Public Management, which here is known as managerial reform or Nova Gestão Pública (NGP). Among the results of this reform came the social organizations, regulatory agencies and a reformulation of the process of public service concessions to private initiative. In this wake, at the beginning of the 21st century, Public-Private Partnerships emerged, special concession models where the State is responsible for part of the concessionaire's remuneration (Sponsored Concession - when the user's fee is not enough for the service) or by its totality (Administrative Concession - the State bears the totality of costs, when it is not possible or allowed to charge the users). In this study, we analyze two Public-Private Partnerships (PPP) carried out by the Municipality of Belo Horizonte: one in the area of childhood education (unprecedented in Brazil) and the other in the area of Street Lighting, that can provide an infrastructure for a smart city system. These are two PPPs at different stages of evolution, and they show how the State should behave and how it may learn from its failures and successes so that PPP can act in the real interest of society.Item Análise econômica do direito das políticas de incentivo fiscal e financeiro destinados às empresas sediadas no Porto Digital e no Parque Tecnológico de Belo Horizonte(Fundação João Pinheiro, 2016-03-30) Costa, Daniel Brant; Wanderley, Cláudio Burian; http://lattes.cnpq.br/8883271568242398; Ferreira Júnior, Sílvio; Leal Filho, Raimundo de SousaThe new position of knowledge and information among the production processes, as well as the change of the university roles, state and industry require a greater interaction between these three levels, with the State acting as regulator / intervenor, creating for such an institutional normative arrangement that allows, encourages and occasionally induces approximation of academic and business spheres. Through the economic model of innovation systems developed by Etzkowitz and Leydesdorff (2000), the Triple Helix III, one can analyze the interaction between Government, University and Firms together or by the perspective of each of the actors involved. An environment where you can observe the interaction of these three spheres focused to generate virtuous cycles of innovation are technology centers, starting with the example of the pioneering Silicon Valley. In Brazil, the state action can be given as an investor, applicant services or products and primarily through tax incentives, financial policies, provision of tools and hands labor, as well as policies aimed at creating technological parks, involving the integration of entities from the Federal, State and Municipal levels. Thus, we sought to evaluate public policies for technology parks from its regulatory framework and according to the reaction to the companies located in the parks and the interaction between them and the university, the government and the parks themselves, in order to verify whether such policies are able or not to fulfill the role to which they are intended. Therefore, we studied the specific cases of Porto Digital in Recife and BHTEC in Belo Horizonte. The objective of the research is to analyze the process of special performance evaluation of public servants during the probationary period, from the perspective of giving them the stability provided by law. It begins by analyzing the stability and the challenge of evaluating public servants. Afterward, some considerations are made about the most recent political debates on the subject, bringing up general concepts, the historical origin of stability, and its provision in the Federal Constitution. Soon after, it enters into the legal instruments provided for in the Federal Constitution that allow and direct the evaluation of public servants, with a greater focus on the special performance evaluation. This is still worked on in the light of performance management in the public sphere, presenting some notes made by the literature on the act of evaluating the public servant. The methodology is based on a case study, giving a more empirical approach to the research, studying the special performance evaluation in two municipalities in Minas Gerais – Campo Belo and Belo Horizonte. The municipal norms of both, which regulate the evaluation during the probationary period, are analyzed, describing in a comparative way how the performance evaluation takes place in each city hall. Nine civil servants were interviewed in each location, highlighting the positive and negative points presented by the interviewees during the evaluation process. Some distinctions were found in the evaluation processes in each location, despite the similarities among the complaints and speeches of the interviewees, regarding their impressions of the special performance evaluation. It concludes by stating that the institute of stability, by itself, does not create obstacles to the proper functioning of the public service, but rather an absence or deficiency in people management, reified, in this work, by the lack of a more specific, concrete and reliable performance evaluation.Item Avanços e desafios da institucionalização da democracia participativa em Belo Horizonte a partir das conferências municipais de políticas para as mulheres realizadas no período de 2004 a 2010(Fundação João Pinheiro, 2012-03-27) Oliveira, Girlene Galgani Reis de; Brasil, Flavia de Paula Duque; http://lattes.cnpq.br/4666930977365902; Brasil, Flávia de Paula Duque; Cunha, Eleonora Shettini Martins; Costa, Bruno Lazarotti DinizThis dissertation analyzes the social participation in the process of elaboration of policies at the Conferences of Public Policies held in Brazil principally on the Lula Government and more specifically from the case study of the Municipal Conferences of Policies for Women in Belo Horizonte. Among the various participatory institutions that guarantee the exercise of democracy, the Conferences of Public Policies are important instances of participation and deliberation, as they offer to the public the opportunity to directly intervene in governmental decisions, presenting guidelines for planning and public management according to the demands presented by different segments of Civil Society. They occur at specific intervals, usually every other year, and they seek the normative direction of thematic areas in Public Policy. The Conferences are organized at the three levels of government (municipal, state and national), and at each level the discussions of the problems perceived by the participants who elaborate proposals occurs, pointing the demands that are collectively approved. The Dissertation has the Municipal Conferences for Politics for Women of Belo Horizonte realized in 2004, 2007 and 2010 as focus and seeks to verify if in the understanding of the councilors of the Municipal Council of Women's Rights the proposals approved at these conferences were used as reference in the elaboration of Public Policies for the Municipal Health Area and if this participatory institution promoted the political and social inclusion of women in the city. Towards this goal, I addition to the relevant literature review, the research turned to documentary surveys and semi-structured interviews with counselors.Item Burocracia de médio escalão em contexto de crise: um estudo de caso sobre os efeitos da pandemia de Covid-19 nas políticas assistenciais de Belo Horizonte(Fundação João Pinheiro, 2022-03-22) Guimarães, Flávia Alves; Costa, Bruno Lazzarotti Diniz; http://lattes.cnpq.br/2084604177044476; Souza, Letícia Godinho de; http://lattes.cnpq.br/4333929511296586; Souza, Letícia Godinho; Costa, Bruno Lazzarotti Diniz; Brasil, Flávia de Paula Duque; Lotta, Gabriela SpangheroThis study proposes to verify if the pandemic of COVID-19 has caused changes in the necessary capabilities for the execution of the social assistance policies developed by the Secretaria Municipal de Assistência Social, Segurança Alimentar e Cidadania de Belo Horizonte (SMASAC), in 2020, and if these changes affected the performance of mid-level bureaucracy of the secretary. This is an exploratory and qualitative research study, which adopted the case study as its research strategy. The case study was operationalized in several stages: delimitation of the case-unit, theoretical review, data collection, analysis and interpretation of the findings. A literature research was conducted that privileged three theoretical dimensions: crisis management, state capacity, and mid-level bureaucracy. The year of 2019 was considered as a reference of the pre-pandemic period, and the year of 2020, for the pandemic period. To understand how SMASAC acted in both periods, a documentary research was conducted, which was based on access to legislation, technical notes, reports on the measures adopted by the municipal administration, management balance sheets, and budget statements. For the purposes of this study, the municipal policies of social assistance, food and nutritional security, and human rights were the social assistance policies evaluated. State capacity was considered as the set of capabilities required to carry out public policies and implement official objectives, privileging the administrative dimension of the concept. Considering the mid-level bureaucrats part of the arrangement of the capacity necessary to execute public policies, through semi-structured interviews and the application of a questionnaire, the perception of these actors from the intraorganizational dimension of public administration about the changes brought by the crisis was captured. By comparing the data obtained about the two periods considered in the research, it was possible to observe the effects of the public health emergency situation on the assistance policies that were being developed by SMASAC. If the objectives until 2019 were focused on the improvement of management and the expansion of priority offerings, in 2020, the guarantee of social protection and emergency food provision became the focus of management. The change in the agency's objectives had effects on the necessary capacities for the execution of public policies. As for the effects of the pandemic on the performance of the mid-level bureaucracy, based on the perceptions of the managers, it was noted that the crisis affected the work regime, the decision-making processes, the interactions with other actors, and the skills required to perform the functions of these government actors. It is expected that the considerations presented in this dissertation contribute to the production of knowledge about the effects of the pandemic of COVID-19 in public administration, especially in social assistance policies; that from the reading of this crisis context it has also been possible to uncover aspects of the performance of mid-level bureaucrats and, consequently, of the back office of municipal management in atypical situations.Item Conflitos e constrangimentos que cercam a implementação de políticas educacionais voltadas para a equidade: o caso da Escola Plural(Fundação João Pinheiro, 2007-11-22) Saraiva, Ágnez de Lélis; Costa, Bruno Lazzarotti Diniz; http://lattes.cnpq.br/2084604177044476; Carneiro, Ricardo; Somarriba, Maria das Mercês GomesThis paper analyzed the problems and conflicts generated in the implementation of the Plural School, educational policy of Belo Horizonte in 1995. He showed that this policy was part of a context of reforms that crossed the various nations of Latin America, at a time where educational systems had inefficient and ineffective. And contributed to the creation and deterioration of educational inequalities between rich and poor. The Plural School was considered a policy for equity understood as recognition of the diversity of educational pathways for students. Educational policies for this purpose proved to be difficult to implement, as required changes in the organization of schools and educational systems, changing routines and amplamentes technologies accepted and rooted historicamentes culture of the population. In addition, they identified other variables that could interfere in the implementation process. Were highlighted the design of municipal managers on the implementation process of the Plural School, the way of its implementation, its organization and management model, the distribution of costs and benefits, the conflicts generated and the intensity of them. The analysis found that there was, among the municipal managers of Belo Horizonte, the certainty of the complexity and difficulty of the implementation process of the Plural School and, therefore, mobilized a lot of resources. However, optimism about the reception of the proposal by the school actors led to an underestimation of conflict and resistance to the new educational policy. The management and management model were adequate. But, for generating a high cost on teachers who should be the implementers, the Plural School faced strong resistance of this actor. Among the costs, there is the need for changes in the organization of schools and teaching work routine, causing the sense of loss and consequently various forms of resistance to its implementation. In three schools analyzed changes were identified. In two of the organizational changes were higher and there was a significant rapprochement between your organization and the design of the Plural School. In one, the changes were small and preserved a lot of the traditional model. However, it was realized an adaptation of the design (macro implementation) and how municipal schools have been organizing and implementing the Plural School (micro). The model of organization and routines of the municipal schools of Belo Horizonte have changed in many ways, but preserved much of the model of education that the school Plural sought to combat.Item Democracia, participação social e política urbana: o direito à cidade e a política habitacional de Belo Horizonte (1993-2018)(Fundação João Pinheiro, 2019-03-29) Maia, Petter Isackson; Brasil, Flávia de Paula Duque; http://lattes.cnpq.br/4666930977365902; Brasil, Flávia de Paula Duque; Carneiro, Ricardo; Andrade, Luciana Teixeira deO crescimento desordenado das metrópoles brasileiras resultou em periferias urbanas com significativos déficits na provisão de bens e serviços urbanos. Nesse quadro socioespacial, destaca-se a problemática habitacional, não equacionada de forma efetiva pelo Estado no decurso do processo de urbanização. A informalidade é instituída, como uma forma de provisão habitacional para as classes trabalhadoras. Diante dessa condição, movimentos populares se tornaram uma importante força de democratização das políticas urbanas. Dessa forma, os atores coletivos que lutam pela reforma urbana têm pautado a gestão democrática das cidades, a função social da propriedade e o direito à moradia e à cidade. Belo Horizonte se enquadra no contexto dessas lutas como uma das cidades que avançaram na formulação e proposição de instrumentos democratizantes inovadores da política urbana, especialmente, na política habitacional dos anos 1990. Como questão norteadora do presente trabalho, procura-se analisar como a participação social e o princípio da gestão democrática têm sido absorvidos pela gestão municipal no caso da política habitacional de Belo Horizonte ao longo do período 1993-2018. De forma geral, argumenta-se que a participação social institucionalizada por meio de instituições participativas, canalizando agendas de movimentos populares e associações ligados à moradia em contextos de governos que privilegiem a gestão democrática pode ser associada a avanços e inovações nas políticas habitacionais. Como recursos metodológicos, recorreu-se à revisão de literatura sobre democracia, participação e deliberação; participação e políticas habitacionais no país e nos governos locais; empresarialismo urbano e modelo de governança neoliberal, além de entrevistas semi-estruturadas. Identificou-se na gestão do prefeito Patrus Ananias (1993-1996), ações no sentido de ampliação da infraestrutura participativa na administração municipal, no âmbito da política habitacional. Os períodos seguintes - Célio de Castro (1997-2001) e Fernando Pimentel (2001-2008), caracterizaram-se por continuidades e descontinuidades da política de habitação. Por outro lado, a gestão de Márcio Lacerda (2009-2016), caracterizou-se pelo contexto de esvaziamento das instituições participativas e priorização das Parcerias Público Privadas, aproximando tal período do modelo empresarialista de gestão urbana descrito na literatura revisada. Such phenomena reverberate in different socioeconomic spheres, demanding that society search for new means of existence, which are more sustainable and respect the Earth's natural limits. In this sense, the current economic model, called Linear Economy, has been, since its origin, harmful to the environment, as it is based on the massive extraction of virgin raw materials, the production, in general, of non-eco-efficient products, rarely designed to be reused or repurposed, and, finally, in planned obsolescence and inadequate disposal, generating waste that is barely recycled or reused. A counterpoint to the linear economic model, the Circular Economy can contribute to placing humanity on a safe and fair level for everyone, combining concern with the Earth's ecological ceiling and the presence of a social foundation. It is a concept that associates economic development with better use of natural resources, through new business models and optimization of manufacturing processes. The expansion of this circular model and its applicability in the urban context gave rise to the term circular city. Circular cities are municipalities where, together with stakeholders, we seek to apply the concepts of circular economy, improving environmental, economic, and social indicators, increasing the city's resilience and longevity, as well as the well-being of citizens. Aiming to explore the application of concepts in the urban environment, specifically in the city of Belo Horizonte, this work's central objective is to analyze the capital of Minas Gerais through the lens of a circular city. Therefore, a narrative review of convenience is used, in order to present the concepts of Circular Economy and Circular City. Next, a chapter is dedicated to the analysis of the cities of Amsterdam, in the Netherlands, and Paris, in France, in the context of Circular Cities. It continues with a chapter that addresses the panorama of the Circular Economy and waste management in Brazil. The penultimate chapter analyzes socio-economic-environmental indicators of Belo Horizonte, related to the theme of Circular Economy, comparing the capital of Minas Gerais with other Brazilian capitals and cities. The last chapter delves into BH's municipal policies and plans, related to the Circular Economy, using document and content analysis, field work, forms, questionnaires, and semi-structured interviews with stakeholders. It is observed that, although Belo Horizonte is not a city in transition to the circular model, it presents solid strategies related to the topic and good reach in some key indicators in the evaluation of circular cities. On the other hand, barriers to the materialization of plans include low integration between government sectors, a lack of political and societal interest in the environmental agenda, interference from the business sector and operational and financial bottlenecks.Item Economia criativa em territórios vulneráveis: estudo de caso do Projeto Seu Vizinho(2021) Carvalho, Ciro César de; Wanderley, Cláudio Burian; Shikida, Aparecida Maciel da Silva; Ferreira Júnior, SílvioEste trabalho busca analisar a economia criativa em relação aos territórios vulneráveis. Ele consiste em um estudo de caso, com ênfase na geração de emprego e renda, sobre o Projeto Seu Vizinho, que atua no Aglomerado da Serra, em Belo Horizonte. Busca-se compreender como a Economia Criativa se organiza em territórios vulneráveis, qual a sua capacidade de empoderar a população local e como gerar emprego e renda para essa população. A Metodologia consiste de uma revisão literária sobre economia criativa, empreendedorismo e territórios vulneráveis; análise documental sobre as políticas públicas voltadas à cultura e ao empreendedorismo em territórios vulneráveis; e na realização de entrevistas semiestruturadas com os fundadores e com aplicação de questionário ao público participante do Projeto Seu Vizinho. Com o estudo foi possível perceber que o Projeto está inserido na economia criativa e é um gerador de emprego e renda para várias pessoas da comunidade. The guarantee of social security is the repertoire of political functions and points to a series of acquisitions that materialize the conception of social protection. The decentralization, as “SUAS” guidelines, confers to municipalities the responsibility for the provision by social assistance services, among them, The Service of Protection and Integral Service to the Family – PAIF, that consist of main service of basic social protection system. This service aims to strengthen the protective function of families and prevent the occurrence of situations of social risk and vulnerability through strengthening family and community ties. The research analyzes the process of implementation of this service in Belo Horizonte, with the goal of mapping the elements that affect the implementation and that compromise the achievement of policy outcomes. The social assistance special features that fall into a typology of policies characterized by low programmability of the actions and the elevated interaction between technicians and users. This and other features put in relief the importance of street-level bureaucrat as a fundamental actor in the delivery of services and in the translation of the objectives of the policy, particularly in translation of social security from the implementation of the services. The literature on implementation of public policies and more specifically on the role of "streetlevel bureaucracy" served as a guide for the analysis. From a qualitative methodology and through the case study of two territories, the research focused on the perception of the technicians who work in Social Assistance reference Centers (CRAS), through nine semi structured interviews, seeking to understand how they perceive and face the challenges of implementation, or how to do the translation between the normative ideals of the politic and its operationalization in the actions offered under the PAIF. The results point to some challenges of the implementation process of the PAIF: conditions of "overlapping authority" over the daily lives of service and commitment to implementing the actions; the difficulties of intersectoral approach in the context of the action, which ultimately overwhelm services; the fragility of methodologies and intervention strategies that take account of the nature of the task, assistance in "loosely articulated systems"; the different interaction strategies developed by the technicians and users to define, in the end, the achievement or not of the scope of social security. The analysis points to the fact that the regulations are not enough to guide the delivery and that politics, rather than all, maybe, the role of street-level bureaucrat is fundamental as primary means of translating intentions into actions, if constituting in the main social assistance intervention technology of Social Assistance.Item A justiça informal em linha de montagem: estudo de caso da dinâmica de atuação do JECrim de Belo Horizonte(2010) Batitucci, Eduardo Cerqueira; Cruz, Marcus Vinícius Gonçalves da; Santos, Andréia dos; Ribeiro, Ludmila Mendonça Lopes; Souza, Letícia Godinho deNeste artigo analisamos a inovação proporcionada pelo Juizado Especial Criminal no interior do Sistema de Justiça Criminal brasileiro, bem como seu efetivo funcionamento – suas práticas e rocedimentos – e as principais características do seu fluxo processual, a partir dos achados da pesquisas sobre o JECrim do município de Belo Horizonte/MG. O artigo consolida resultados de um conjunto de pesquisas tanto qualitativas quanto quantitativas sobre esta instância processual, onde se buscou desde a análise de atitudes, valores e crenças de seus membros, até um levantamento sistemático dos tempos do fluxo dos processos julgados. As conclusões apontam para o questionamento do JECrim/BH como uma instância relevante para a solução de conflitos em Belo Horizonte, em virtude do longo tempo médio encontrado para a solução processual de um caso típico, em virtude da forte burocratização implementada pelo juizado, bem como à prevalência de uma cultura jurídica excessivamente formalista junto a seus atores institucionais.
